Is it possible to file a lawsuit if you survive a plane crash?

Florida law allows crash survivors or their families to be compensated for an aviation accident by filing a legal claim and seeking compensation from the at-fault party for damages.

A plane crash lawsuit settlement can be reached in many cases without formally trying a case in court.

If the crash was caused by the negligence or wrongful actions of others, survivors or their families may have legal grounds to file a lawsuit such as:

  • Negligence claim - if the crash resulted from a party's negligence. It could involve demonstrating that the responsible party failed to provide reasonable care, leading to the collision and resulting in injuries.

  • Product liability claim - if the crash was caused by a defect in the aircraft or its components, survivors may file a product liability lawsuit against the manufacturer or distributor of the malfunctioning equipment.
  • Breach of contract - if the crash occurred due to a breach of contract, such as a failure to adhere to safety standards or contractual obligations, survivors may have a legal basis for a lawsuit.
  • Wrongful death claim - in the unfortunate occurrence of fatalities resulting from the crash, surviving family members may file wrongful death claims to receive indemnification for their losses.
